Both data privacy and information confidentiality are important aspects for the Pasqual Maragall Foundation. This data protection policy establishes how personal data obtained from clients, partners, contacts, vendors and collaborators are treated and it may vary with time due to the possible legislative, jurisprudential changes, or changes of the criteria followed by the Spanish Data Protection Agency and/or the competent authority at any time. For this purpose, the Pasqual Maragall Foundation reserves the right to modify this policy to adapt it to legislative or jurisprudential developments that are in force at the precise moment of website access.

The Foundation processes your data according to the collaboration relationships that you have with us. The data that we collect are those strictly necessary to manage established relationships; these data are appropriate, relevant and not excessive, limited to what is required for the purposes of their processing. In order to keep current data accurate and updated, we ask you to report any change or modification that may occur.
The activities performed by the Foundation are described below so that you can identify on which databases your personal data are processed and for what purposes:

Deletion period: data as partner and/or donor will be stored for the duration of the established collaboration relationships and will be deleted subsequently, once the periods legally established for the prescription of civil, criminal, and fiscal obligations have elapsed.

- Management of the services contracted: vendor registration, management of contracts, orders, and payments.
- To maintain a contact database for future potential recruitment and/or collaborations.

Deletion period: data will be stored at all times for the period of the contractual relationship and subsequently for the legal periods established in the civil law for the termination of contractual obligations and the accounting and tax legislation.

- In order to maintain a file with CV information of the candidates who will provide services to our company and whose profile meets the characteristics requested by the company.
Legitimation: the legal grounds for the processing of your data is your consent, which is considered given, with the voluntary submission of the CV.
Deletion period: data will be stored for a maximum of 2 years and will be deleted subsequently.
Legitimation: the legal grounds for the processing of your data is the legitimate interest of the Foundation to control the access and safety of the work site.
Deletion period: personal data collected will be stored for a maximum of one year and will be deleted subsequently.
Legitimation: the legal grounds for the processing of your image is the legitimate interest of the Foundation in the video surveillance and safety of the work site.
Storage period: the images will be stored for a maximum of one month and will be deleted subsequently.
A. REGISTRATION & APPLICATION FORMS:
Data registered on the programme platform, mail or other contact method indicated.
Purpose: Manage your questions and requests and send you communications of interest about the Programme.
Legitimation: the legal grounds for the processing of your data is your explicit consent when providing your data and accepting the PMRP data protection policy.
Deletion period: data will be stored indefinitely as long as their deletion is not requested.
B. CV MANAGEMENT
The personal data that you provide us with when you send us your CV will be processed for the following purposes:
- For selection during the processes that the PMRP keeps open.
- To maintain a file with CV information of the applicants and applicants’ teams.
Legitimation: the legal grounds for the processing of your data is your consent, which is considered given, with the voluntary submission of the CV.
Deletion period: Your CV will be stored for a maximum of 5 years and will be deleted subsequently, except due to different project or grant requirements.
3. Who will we communicate your personal data to?
The Foundation will communicate your data in the following events:
By legal obligation: to the tax administration for the payment of taxes, to judges and courts that request it by judicial means.
Transfer required to conduct the services contracted: financial entities to execute the applicable collections and payments. We inform you that your data may be transferred to Barcelonaβeta organization, the collaborating entity of the Foundation with whom it shares projects, services and provisions.
The data of the candidates for the employee position who have sent their CV may be communicated, according to their profile and the position to which they apply, to organizations, companies or institutions, at both a national and an international level, with which the Foundation has agreements or preliminary agreements of collaboration or common projects, so that they can assess their suitability as candidates.
For the Pasqual Maragall Researchers Programme, neither the PMRP nor Pasqual Maragall Foundation will communicate your data to third parties except for evaluation purposes to the public agency coordinating the external evaluation process and the members of the Pasqual Maragall Researchers Programme Selection Board.
International data transfer: the Foundation will not carry out any international transfer of your data.
4. What are your rights in terms of data protection and how can you exercise them?
Any person has the right to obtain information about which of his/her data are being processed in an organization. For this purpose, the Foundation indicates your rights below:
Right of access, rectification and erasure: the interested parties have the right to access their personal data, and to request the rectification of inaccurate data or, when applicable, to request their erasure when, among other reasons, data are no longer necessary for the purposes they were collected for.
Right to restriction of processing: under certain circumstances, you may request the restriction of your data processing, in which case data will only be stored for the exercise or defence of complaints.
Right to object to processing: under certain circumstances and for reasons related to your specific situation, you may object to the processing of your data. The Foundation will stop processing the data, unless for compelling legitimate reasons, or the exercise or defence of potential complaints.
Right to data portability: you will have the right to receive the personal data concerning you in a structured, commonly used and machine-readable format when: a) the processing is based on consent or on a contract, and b) the processing is performed by automated means.
Right to lodge a complaint with a supervisory authority: we inform you of your right to lodge a complaint with a supervisory authority (AEPD – www.aepd.es) in the event that the exercise of your rights hereby indicated has not been met.
In order to exercise the above-mentioned rights, you may contact us through postal or electronic mail to the addresses indicated in section 1, identifying the information below in your request:
- Applicant’s data (name and surname(s)).
- Contact address.
- Right to be exercised.
- Specific data based on which your request is made.
Within a maximum of one month, we will solve your request by notifying you through the same means that was used initially.
5. What security does the Foundation apply in the treatment of your data?
Taking into account the condition of the technique, the costs of application, and the nature, scope, context and purposes of the processing, in addition to risk of varying likelihood and severity for the rights and freedoms of the natural persons, the Foundation will apply appropriate technical and organisational measures to ensure a level of security appropriate to the risk, which prevent the destruction, loss or accidental or illicit tampering of personal data transferred, preserved or processed otherwise, or the unauthorized disclosure or access to such data.
Privacy Policy – E-mail confidentiality
All e-mails sent from Pasqual Maragall Foundation domains may contain confidential or legally protected information and are exclusively addressed to the person or entity to which it is addressed. The content of these messages do not imply any commitment by the sender. If you are not the final recipient or person in charge of collecting it, you are not authorized to read it, retain it, modify it, distribute it, copy it or reveal its contents. If you have received an email by mistake, please inform the sender and remove the message, and the attached material that may contain, from your system.
