The Pasqual Maragall Foundation, in its aim to promote knowledge in all areas of Alzheimer's disease, has organized, together with the Notarial Association of Valencia, a conference at the Caixa Forum Valencia with the aim of promoting dialogue and reflection on legal prevention, both for legal professionals and for families affected by this disease.
The event, attended by more than 150 people, was moderated by the journalist Marta Ventura and taught by Mrs. Maria Consuelo Bombal Quiros, Notary of Chirivella and president of INDISVA (Notarial Institute for Legal Assistance to People with Disabilities of Valencia), together with Julia Pons, Psychologist and Therapist at the Pasqual Maragall Foundation, has highlighted the different legal elements, providing useful tools and relevant information on the subject.
Solid legal planning is key to good legal prevention
At the meeting, the different legal documents to be taken into account when faced with an Alzheimer's diagnosis were explained. preventive power which allows the person to be chosen to administer the estate, who must be chosen before the loss of capacity; self-protection, to determine who will take care of the diagnosed person and the estate in the event of a judge's decree of loss of capacity. Also, advance directives or living will, to decide whether specific therapeutic procedures will be accepted or rejected in the future, and the designation of a representative who can communicate with medical staff if necessary. “Law 8/2021 has brought about a profound modification of the legislation on disability, where the basic principle has become respect for the will, desires and preferences of the person. As a result, notaries have come to the forefront of providing advice to help each person establish the support measures most appropriate to their situation, leaving judicial measures as a last resort.”, Ms. Maria Consuelo Bombal has pointed out.
For its part, Julia Pons He explained the importance of addressing situations of advanced incapacity, where the Civil Code allows the appointment of a guardian to ensure the well-being of the affected person. “In the event of an Alzheimer's diagnosis, having adequate legal preparation to deal with the disease can be essential, since there are highly beneficial legal tools for deciding by whom and how we wish to be cared for, as well as for managing assets appropriately. Therefore, this conference represents another step towards raising awareness about the importance of anticipating legal problems and working on prevention as a basis for a more just and equitable society.”, Pons stressed.
